Sharpo Incorporated is a California corporation that provides live entertainment services including Murder Mystery Events, Variety Acts, Live Comedy Events and Magic Shows. TRADEMARKS - Sharpo.com® mark is used in regards to promoting the aforementioned live entertainment services as well as streaming entertainment content via the internet including, but not limited to: webcasting, podcasting, RSS, and other digital media. Sharpo!® mark is used for all Sharpo Incorporated services. ALL RIGHTS RESERVED. Sharpo Incorporated is not affiliated in any way with any other makers of licensed, trademarked famous characters and makes no claims to the contrary. Let there be no confusion whatsoever, in the mind of the consumer in regards to the services provided by Sharpo Incorporated. SERVICE TERMS AND CONDITIONS PERFORMER POLICY - Sharpo!® provides party entertainment including characters played by actors and professional performance artists. Sharpo!® does not guarantee an appearance at any event by any specific actor or specific professional performance artist. Casting and number of performers for Murder Mysteries and Sketch Comedy Shows shall be at the discretion of Sharpo!® unless otherwise specified in writing, email, or fax to customer. PERFORMANCE RIGHTS AND ROYALTIES: Customer agrees to prominently include mention of the brand name "Sharpo!®" in all their print and media promotion of events featuring Sharpo!® performers, or performers working on behalf of Sharpo!®, unless mention is waived as part of a written contract. Sharpo!® events are protected by US and international copyright law. Home videos and photographs are permitted but no Sharpo!® event may be captured on video for professional purposes or distributed on the internet, television, radio, or reproduced in any way without express written permission from Sharpo!® Event producers. PERFORMANCE AREA: Customer is responsible for providing the performance area for Sharpo!® entertainers. Customer agrees to inform Sharpo!® if any special permits are required. Customer agrees to pay for all permits and parking fees required for Sharpo!® entertainers to perform in public areas. Please note that Sharpo!® Murder Mystery Events require a "Backstage area" that is off limits to the audience. PERFORMANCE DURATION: All Sharpo!® entertainment services are provided as time and conditions permit and can be terminated early at Sharpo!® Producer's discretion if he/she determines that performance conditions are unmanageable. If Sharpo!® producer or customer terminates the entertainment services or performance early, customer agrees to pay the full balance due. Unless otherwise specified in writing, the duration of Sharpo!® performance including set up and break down shall not exceed 6 (six) Hours. Overtime charges for murder mystery production are $400 per hour and will be charged to the customer’s credit card. PERSONALIZING/ CUSTOMIZING EVENTS: Content and props supplied by customer will be used at the discretion of the Sharpo!® Producers as time and conditions permit. SERVICE ORDER DISCREPANCIES: The Sharpo!® price quote is sent to the customer by email or fax and is based on many factors including, but not limited to the number of guests, our availability, and the distance to the event. Customers are advised to review their service order carefully! Total price, deposit, balance and travel charge entries must match the price quote that customer has received by email or fax from Sharpo!®. In the case of a discrepancy, the price quote sent to customer by email or fax shall be considered the true price and the customer will be billed for that amount. CANCELLATION POLICY: A Cancellation of the event by customer will result in a forfeit of deposit. Monies paid to Sharpo!® on a canceled event may be used for an upcoming event. Rescheduled date must be one year or sooner from the date of the original event. DEPOSITS AND BALANCES: Deposits must be received within 5 business days of service order or entertainment services may be canceled and a new availability and price quote would then need to be received by customer to reorder. Balance is due and payable in full prior to the start of performance. A check may be used for the balance due. If balance is not paid by check at the event then the credit card on file will be charged the outstanding balance. If no credit card is on file and balance is not paid prior to start of performance, then performance may be canceled at the discretion of the performer resulting in a forfeit of the customer's deposit. TRAVEL AND LODGING: Travel and lodging costs are included in the TOTAL PRICE. MURDER MYSTERY ATTENDEE NOTIFICATION: When ordering Sharpo!® Murder Mystery events, customer is strongly advised to inform their party guests that they are attending a murder mystery party PRIOR to guests' arrival to event, or at the very latest, UPON guests' arrival. Sharpo!® provides a greeter to hand out Sharpo!® Murder Mystery Welcome Letters as guests arrive. A "Cold Opening" is defined as a murder mystery event where the audience is unaware that a murder mystery event is happening until a murder is staged in their presence. Customer understands that a Cold Opening Murder Mystery is a deviation from Sharpo!® 's critically acclaimed interactive hit show format and audience response can be unpredictable. Sharpo!® Incorporated strongly advises against Cold Opening Murder Mysteries. The exception would be when surprising a guest of honor, IE a surprise Party for a Birthday. All of the other party guests should still be informed they are attending a murder mystery surprise party for their guest of honor. LIABILITY: Sharpo!® is not responsible for the supervision and safety of the attendees at Sharpo!® Incorporated events or at venues or locations where Sharpo!® entertainment services are provided. The person or organization ordering Sharpo!® entertainment services accepts full responsibility for the safety and supervision of their party guests and agrees to defend and hold harmless Sharpo!® and its owners, including employees and sub-contractors from and against any liability and all loss, cost, damages, expenses, including attorney fees on account of claims for personal injury. By accepting entertainment services provided by Sharpo!®, Customer acknowledges that they have read, understand and agree to the terms and conditions outlined herein. Order On Line
